【抄訳】 明大ローレンス・レペタ教授による #自民党憲法改正草案 に関する外国特派員協会での記者会見+論文全訳(英日対訳)|ビデオニュース・ドットコム(2013.02.23)

2013年2月21日、明治大学法学部特任教授のローレンス・レペタ氏が日本外国特派員協会(FCCJ)で自民党の憲法改正草案を批判する記者会見を行った。この模様をビデオニュース・ドットコムが取り上げた動画を、英日併記で原文含めて起こし和訳しました。

会見抄訳

It's very very clear from their document that their world vision means they'll be detached from the common global understanding of fundamental rights.

自民党が、国際社会で広く共有されている基本的人権の認識から脱却した世界観を持っていることは、彼らの文書(自民党憲法改正草案) からも、きわめて明白です。

In addition to deleting Article 97, which is a specific guarantee of fundamental human rights, in addition to the statement in their "Q&A" that says they reject what they call the 'Western notion of natural rights', they also proposed changes to the Preamble of the Constitution; they would delete references to universal rights, which are currently in the Constitution. 

自民党は、基本的人権の尊重を定めた97条の削除のほか、『Q&A』に書かれたように(※)「天賦人権思想(人は生まれながらにして人権を有すという考え方)に基づいたと思われる」自然権に対する考え方を拒絶することに加え、憲法前文についても変更を提案しており、憲法に現在記載されている普遍的権利に関する条項も削除するとしています。(※但し、リンク先の『Q&A』は「増補版」なので、2013年時点でここで述べられているものとは内容が修正されていて異なる可能性あり。)

And of course the idea of... when you think about 'when' the Constitution was drafted -- it was the late 1940's, it was immediately after the most horrible war the world has ever experienced, the United Nations was formed in 1945, two years before the Japanese Constitution came into effect, the Universal Declaration of Human Rights was adopted one year after Japan's Constitution was formally adopted. 

そもそも、基本的人権の考え方ーすなわち、「いつ」日本国憲法が起草されたかを考えると、それは1940年代後半のことであり、世界が経験したことのない凄惨な大戦の直後のことであり、国際連合は日本国憲法が公布される2年前の1945年に設立されており、さらに、日本国憲法が正式に採択されたその1年後に、世界人権宣言が採択されています。

So Japan's Constitution came into being during this period when the world was awakening to the notion of protecting fundamental human rights. 

つまり、日本国憲法は、世界が基本的人権の概念に目覚め始めた、まさにその時代に生まれたものなのです。

At this point, if you look at the LDP document, it says, "Well, that's wrong. We don't want to be part of that. Rights that will be recognized in Japan are those rights which are based on Japanese culture and Japanese history -- obviously as they interpret Japanese culture and history -- and this is not a matter of any universal understanding."

ここで、自民党案に立ち戻ると、彼らは、「それは間違っている。我々はそれには与しない。日本には独自の文化や伝統があり(勿論、彼らの解釈する文化や伝統であるわけですが)わが国で認められる人権は、これらの文化や伝統にしたがって決められるべきものであり、普遍的な認識などの問題ではない」と、いう主張をしているのです。
