１．はじめに

２０１９年１月９日、米国で行われている沖縄・辺野古ジュゴン訴訟原告団のメンバーである全米環境保全団体「生物多様性センター」（Center for Biological Diversity、CBD）※が報道声明を発表。今月開始された控訴審での審理のために用意した「冒頭陳述書」（Opening Brief）を公開するとともに、沖縄・辺野古の大浦湾における在沖縄海兵隊による新飛行場建設を巡る米国での法廷闘争が再開されたことをあらためて表明しました。

２．2019/1/9付CBD声明要旨

・絶滅危惧種ジュゴンの保護のために、国家歴史保全法（NHPA）違反に関する訴訟においてサンフランシスコ連邦地裁で国防省を相手に訴訟中の国内外の環境保全4団体と沖縄の現地住民3名で構成される国際原告団が、控訴審に提出する冒頭陳述書（英文PDF）を公開。

・国際原告団（代理人・Earthjustice）は、沖縄宜野湾市辺野古沖に米海兵隊飛行場を新設することについて、米国内法 [訳注: 国家歴史保全法] に照らした違法性を9月に主張したがこれを棄却され、控訴した。今年1月から控訴審を迎え、同2日に冒頭陳述書を提出した。

・ロックバンド「クイーン」のギタリスト、ブライアン・メイ氏を含む数十万の人びとがホワイトハウスの「We The People」請願署名に署名した [補足: 2019年1月10日現在で約２０万人]。

・サンフランシスコ第9控訴審法廷は2017年8月の一審判決で法廷は「外交安全保障に係る案件のため地裁には判断する権限ない」とする　国防省側の主張を退け、「沖縄の現地住民にはその懸念を十分に訴える審理の機会が認められる」とし、原告団に訴訟を提起する権利があることを認めた。

・CBD共同創設者のピーター・ガルビン博士「基地の建設は沖縄のジュゴンにとって大量絶滅イベント（ELE）級の規模の被害をもたらすのにも拘らず、米軍はこの大人しい生物への脅威をまったく無視してきた」と述べ、「トランプ政権には、基地建設がジュゴンや沖縄の先住民文化にどれほどの損害を与えるか、完全な精査を行う必要がある」と指摘。

・「冒頭陳述書」は前回判決が国家歴史保全法に基づく公共参加の手続要件を見過ごしたと主張。国防省側は飛行場建設の潜在的脅威についてコミュニティのメンバーに説明することを忌避し、損害の証拠を無視してきたと指摘。

・ジュゴンは日本の文化財保護法の対象に指定されており、米国家歴史保全法及び国際法に基づき、米国政府には他国における文化財に対する危害を避ける或いは低減することが義務付けられている。

Legal Battle Begins in Appeal Challenging U.S. Base's Threat to Rare Okinawa Dugongs

SAN FRANCISCO— American conservation groups and residents of Okinawa have filed the opening brief in an appeal of a court ruling allowing construction of a U.S. Marine Corps air base in the Japanese island’s coastal waters.
The brief, filed in the 9th Circuit Court of Appeals in San Francisco, highlights the base’s threat to the Okinawa dugong, a critically endangered marine mammal related to manatees.
Hundreds of thousands of people, including Queen guitarist Brian May, have signed a petition against the project on the White House’s “We the People” website. Building the base will involve filling in and paving over hundreds of acres of rich coral and seagrass habitat crucial to the last surviving Okinawa dugongs.
The Center for Biological Diversity, Turtle Island Restoration Network and the Japanese co-plaintiffs are represented in the case by Earthjustice, which filed the appeal. The 9th Circuit ruled in 2017 that Okinawa residents deserved a full hearing on their concerns.
“This base will be an extinction-level event for the Okinawa dugong, but the U.S. military has ruthlessly disregarded the threat to these gentle creatures,” said Peter Galvin, cofounder of the Center. “The law clearly requires the Trump administration to fully consider how much damage this project will do to the dugong and Okinawa’s indigenous culture.”
Dugongs have long been revered by native Okinawans. The brief argues that a lower court’s ruling last year overlooked key procedural and public-participation requirements of the National Historic Preservation Act.
The brief notes that the U.S. Department of Defense avoided consulting with any community members or cultural practitioners regarding the airbase’s threats to the dugong. Military officials also disregarded evidence that the base will hurt dugongs.
The dugong is listed as an object of national cultural significance under Japan’s Law for the Protection of Cultural Properties. Under the U.S. National Historic Preservation Act and international law, the United States must avoid or mitigate harm to places or things of cultural significance to another country.

３．2019/3/19付米下院軍事委員会宛て合同書簡（要旨）

・国防総省に対し、沖縄の辺野古・大浦湾での一切の工事作業を停止するよう求めることを要請する。

・国防総省の関係者らは、米環境法に対する違反、沖縄の環境上・文化上最も需要な湾に対する明白な損害行為を訴える訴訟が現在進行中であるにもかかわらず拙速に行動しており、これら海域での工事作業を進めることで取り返しのつかない損害を生じさせている。

・この事実に加え、国防総省の行動は2019年2月24日に実施された民主的な県民投票を愚弄している。法的拘束力がないとはいえ、沖縄の有権者の圧倒的な大多数が基地建設に反対した。この歴史的な投票には、基地建設に対する現地住民の広範な反対と心痛を露わにした。

・基地建設には沖縄の現県知事である玉城デニー氏も反対している。知事は防衛省に対し、工事の即時中止を強く訴えている。

・計画されている海兵隊飛行場施設は、多様性に富む沖縄の二つの湾を破壊する。初期の工事はすでに開始されており、絶滅危惧種である「沖縄ジュゴン」(フロリダに生息する「マナティ」と同種）の主な生息地である繊細な珊瑚礁や海藻の広がる海底を破壊し始めている。

・米環境法を遵守することなく当該軍飛行場施設の建設工事を完了すれば、これらの温厚な海洋ほ乳類の絶滅をもたらしかねない。
・ジュゴンは沖縄先住民から神聖視されており、日本の文化財保護法においても特別天然記念物に指定されている。

・国防総省は長きにわたり監督下の土地に対する環境や土地の保護を慈善的に行いながらも、国家の安全を保障してきた実績がある。両者は補完的かつ互恵的な関係にある。多くの問題を抱える基地のために無頓着に埋立て作業を進め、ご都合主義により辺野古湾と大浦湾を破壊してはならない。
・「沖縄ジュゴン」を絶滅せしめるのは国防省の永遠の汚点になるばかりか、最高度の倫理的欠如を示すことになる。絶滅危惧種の繊細な海洋上の生息地を破壊することはわが国自身が受け継ぐ自然の恩恵をも脅威に晒す行為となる。そのような行為は母国においても、国外においても許されるべできはない。

・国防総省は目下、沖縄の文化遺産を保護するという国家歴史保全法の義務規定違反について第9上訴裁判所で係争中である。同省の活動に制約を設けないことは、環境だけではなく、法の支配をも蔑にする行為であり、これは法の下で政府が活動するということを国民が保証できないことをも意味する。

・我々諸団体の代表は下記署名の下、貴委員会の監督権及び立法権を行使して、国防総省に対し、その頑迷な態度を改め、沖縄基地問題に対して合衆国のあらゆる環境関連法を尊重し、また配慮のある形で対応するよう求めるよう要請する。

We request your assistance in urging the U.S. Department of Defense to temporarily stop all construction activities in Henoko and Oura bays in Okinawa, Japan. Despite an ongoing lawsuit challenging the Department’s failure to abide by U.S. environmental laws and despite clear damage to two of Okinawa’s most environmentally and culturally important bays, Department officials are acting rashly and causing irreparable harm to the environment as construction moves forward on this new airbase in these waters. Worse, the Department’s actions fly in the face of a recent democratic referendum on February 24, 2019, in which an overwhelming majority of voters in Okinawa opposed the base construction in a non-binding referendum. This momentous vote highlighted the broad and heartfelt local opposition to the base’s construction. The base construction is also opposed by Okinawa’s new governor, Denny Tamaki, who has strongly urged Japan’s Defense Ministry to stop work on the project. The proposed Marine Corps airbase will permanently destroy two ecologically rich bays in Okinawa. Early construction activities are already beginning to devastate sensitive coral reefs and sea grass beds that are key habitat for the critically endangered Okinawa dugong — a relative of the Florida manatee. Completion of this airbase without compliance with U.S. environmental laws will likely result in the extinction of these gentle marine mammals. Dugongs have long been revered by indigenous Okinawans, and they are objects of national cultural significance under Japan’s Law for the Protection of Cultural Properties. The Defense Department has a long history of acting as a good steward by protecting the environment and land under its care, and at the same time ensuring our nation’s security — the two are complementary and compatible. The Department should not blithely plow ahead with a controversial base and rush to destroy Henoko and Oura bays out of expediency. Driving the Okinawan dugong extinct would not only be a permanent blight on the Department of Defense —it would also represent a moral failing of the highest order. Our own natural
heritage is at risk when we destroy sensitive ocean habitats and endangered species. We would not condone such activities at home, nor should we condone them abroad. A lawsuit pending in the Ninth Circuit Court of Appeals is challenging the Department of Defense’s failure to comply with its mandatory duties to protect Okinawa’s cultural heritage under the National Historic Preservation Act. To sanction the Department’s construction activity not only undermines the environment; it also undermines the rule of law and ability of citizens of this nation to ensure their government abides by its own laws. We the undersigned groups ask you to use your Congressional oversight and legislative powers to request that the Department of Defense cease its stubborn behavior and address the Okinawa base construction in a thoughtful and respectful manner that complies with all U.S. environmental laws.
