1. はじめに

私は現在、UC BerkeleyのロースクールにLLM生として在学しています。とはいえ、日本からLLM留学に来ている多くの方とは異なり、私は日本での法曹資格を持っていません（日本の大学の法学部卒＜法学士＞であり、日本のロースクールにも通ったことはありません）。
そうした中、先日、カリフォルニア州司法試験（California Bar Exam）の受験資格を確認するために必要な資格評価を評価機関にお願いする機会がありました。同様のバックグラウンドを持つ方が周囲におらず、また日本語で得られる情報もウェブ上に少なかったため、自身の備忘としてこの記事を書いています。

同様の悩みを持つ方の参考になればと思いますが、ルール等は変化する可能性もありますので、あくまで参考情報の一つとして捉えていただければと思います。加えて、この記事を書いている時点では、筆者の受験資格は確定していません（＊先日Office of Admissionsから連絡があり、受験資格が確定しました）。誤りなどがあれば適宜修正・アップデートする予定です。

なお、基本的にはState bar of Californiaの以下のページから必要な情報は入手できるものと思われます。

2. General Applicantsについて

大前提として、米国外で弁護士資格を持つ人（"Attorney Applicants"）は、所定の手続きを踏むことでカリフォルニア州司法試験を受験することができます。米国ロースクールでのLLM卒業も不要です。

一方、米国外で弁護士資格は持たないものの、First degree in law（私の場合、日本の法学士）を取得した人の場合、General Applicantsとして登録を行うことが出来ます。この場合、Cal barの試験委員会が承認した資格評価機関に日本の大学の成績証明書や卒業証明書を提出した上で、このFirst degree in lawの学位が（A）米国のJDと実質的に同等であるか、もしくは（B）学位を取得した国において弁護士資格取得のための教育要件を満たしているか、のいずれかを示してもらう必要があります。

"A general applicant who has a first degree in law from a law school located in a foreign state or country must:

(A) Obtain from a credential evaluation service approved by the Committee of Bar Examiners (CBE), a certificate that the applicant’s first degree in law is substantially equivalent to a Juris Doctor degree awarded by a law school approved by the American Bar Association (ABA) or accredited by the CBE; or

(B) Obtain from a credential evaluation service approved by the CBE, a certificate that the applicant’s first degree in law meets the educational requirements for admission to practice law in the foreign state or country in which it was obtained."

3. 資格評価機関 (Credential Evaluation Services)について

上記の証明書を発行できる、試験委員会が認定した資格評価機関の一覧は以下に記載されています。基本的な流れとしては、ここに記載されている評価機関のいずれかに対して所定の申請を行い、必要な書類を送付し、評価結果を待つ、という流れになります。

上記の資料には10の評価機関が掲載されています。重要な点として、評価機関によって評価結果は変わりうる、ということがあります。すなわち、評価機関Xでダメ（自分の学位がGeneral Applicantsとしての要件＜上記(A)と(B)＞を満たさない）だったとしても、評価機関Yでは要件を満たしていると評価される可能性があります。

例えば私の場合、上記リストのIERF(International Education Research Foundation)にまず評価を依頼したところ、必要資格を満たさないとの評価結果が返ってきました。一方、ERES(Educational Records Evaluation Service)に依頼したところ、上記(B)の要件を満たすとの評価結果になりました。結果的に、後者の評価証明書を用いてCal barに登録を出しました。

私が試したのは上記2先だけですので、他の評価機関に依頼していたらどのような結果が出ていたのかは不明です。もっとも、仮にいずれかの評価機関から要件を満たさない旨の評価結果を受領したとしても、別の評価機関に依頼すれば要件を満たす可能性があるため（評価料は掛かりますが）、必ずしも落ち込む必要はないかということかと思います。

なお、評価を依頼する際、どの評価機関も「Cal barのAdmission Officeに評価結果を直送する」というオプションを推奨していると思いますが、仮に要件を満たさない場合登録申請自体が却下されてしまう可能性があります。
このため、評価結果の送付方法については一旦、「厳封(seal)の上依頼者本人に郵送する」とのオプションを選択することが無難だと思われます。多くの評価機関は事前にunofficialな評価結果をメール等で本人に通知するため、これを確認した上で評価結果を用いるか判断することができます。
*評価結果は、評価機関によって厳封されていれば、本人からAdmission Officeに郵送することが可能です。

4. 具体的な登録方法

General Applicantとして登録するためには、まずアカウントを作成し、オンラインの登録フォームを記入し、登録料（$150）を支払います。

並行して、資格評価機関が作成し、厳封した"Law degree equivalency report" および “Foreign Law Study Evaluation Summary (+course by course evaluation)” を郵送でCal barのadmissionオフィスに提出することになります。
ちなみに評価機関によっては申し込み時の書きぶりが曖昧なのですが、私が利用したIERFとERESは、いずれもequivalency reportとevaluation summary（含むcourse by course evaluation）の両方を作成した上でこれらを厳封して私に送り返してくれました。
*2024年3月3日時点のサイト上の記載をみると登録料は$119とされていますが、2024年1月1日から料金の改訂が行われたため、実際の登録料は$150です。

"Law students in this category seeking to qualify to take the California Bar Examination must provide the following to the State Bar’s Office of Admissions in Los Angeles:

1. A completed "Registration as a Foreign Educated General Applicant” form with the required registration fee of $119（このフォームはオンラインで申請することで代えられるはずです）

2. An evaluated law degree equivalency report and a “Foreign Law Study Evaluation Summary” form, which must be completed by a credential evaluation agency approved by the Committee. A detailed course by course evaluation report is required"

補足: LLMでの単位取得要件

General Applicantsは、上記の学位要件に加えて、所定の米国ロースクール（LLM）において必要な科目を履修することが求められます。具体的には、barの試験科目から最低4科目12単位を取得して卒業することが求められます（下記A.）。4科目のうち1科目は法曹倫理である必要があります。
*なお、下記Bの要件は2年制LLMが念頭に置かれていると理解しています。

開講されている科目のうち、具体的にどれが下記の要件を満たすのかは、各ロースクールが把握しているものと思われます（例えば、私が在籍しているUC Berkeleyのロースクールでは、bar要件を満たす科目のリストをLLM生向けに配布しています）。

"Applicants must submit these certificates to the State Bar Office of Admissions. They must also submit a certificate from a law school approved by the ABA or accredited by the CBE certifying that the applicant has either:

A. Been awarded a Master of Law degree (LLM) based on a minimum of 20 semester or equivalent units of legal education. That education shall include no fewer than a total of 12 semesters or equivalent units with a minimum of one course in four separate subjects tested on the California Bar Examination. One of the four courses must be Professional Responsibility that covers the ABA Model Rules of Professional Conduct, and leading federal and state case law on the subject; or

B. Successfully completed 20 semester or equivalent units of legal education, in a LLM program. That education shall include no fewer than a total of 12 semesters of equivalent units with a minimum of one course in four separate subjects tested on the California Bar Examination. One of the four courses must be Professional Responsibility that covers the ABA Model Rules of Professional Conduct and leading federal and state case law on the subject.

C. Prior to June 18, 2021, the guidelines required that foreign-educated applicants complete a Professional Responsibility course that included California-specific Professional Conduct Rules in addition to the ABA Model Rules. That requirement was removed in June 2021. Professional Responsibility courses taken prior to June 18, 2021, which did not meet the prior standard but do meet the above standards, may be used to satisfy the above requirements.

1. All course work for the degree and for the legal education required by the guidelines must be graded using the standards the law school uses in grading course work of students in its JD degree program. An applicant must receive a passing grade in all courses.

2. The degree or the course work required by the guidelines must be awarded or completed, as applicable, within three calendar years of the date the applicant began qualifying study at a law school, whether or not the LLM degree is awarded by or the course work is completed at that law school. An applicant begins study on the first day of their first semester or term of qualifying study."
