【グリーンカード申請】5日で承認！Request for Evidenceの対処法実録

こんにちは～！アメリカ・シリコンバレー在住のSeikaです😊

私は結婚ベースでグリーンカードを申請しています。
グリーンカードの書類送付、指紋採取と証明写真撮影も終わった～と思っていたら、突然Request for Evidenceというお便りが移民局から届きました。
かなり焦ったもののの、落ち着いて資料を準備し提出、5日後に無事に承認されました。

今回は、どんなふうに対処したのかまとめていきたいと思います。

これから結婚ベースでグリーンカードを申請する方、
RFEのお便りが届いた方、
結婚して間もない方、
勤務地の本社と自宅の住所が遠い方
グリーンカードを自分で申請する方

1、Request for Evidence（RFE）とは

1、Request for Evidence（RFE）の説明

「Request for Evidence（証拠の提出要求）」は、移民局（USCIS）が申請者に対して追加の証拠や情報を提出するよう要求する手続きのことを指します。

結婚ベースの申請においては、
申請者が自分たちの結婚が本物であること、
また結婚が合法であることを証明する必要があります。
通常、申請時に提出される書類や証拠が不十分である場合、
移民局はRFEを発行して追加の証拠を提出するよう要求します。

RFEを受け取った場合、指定された期限内に必要な証拠や情報を提出する必要があります。
証拠の不十分なまま期限を過ぎて提出しない場合、申請は拒否される可能性があります。
したがって、RFEへの迅速かつ適切な応答が重要です。

2、なぜ届いたのか

私の場合、証拠が不十分とされたのは以下2点です。

1、結婚関係が本物かの証拠が足りないこと。
2、私の住所と勤務先の住所の州が違っていること。

1に関しては、複数証拠資料を出していたのですが、それでは証拠として不十分ということでした。

2は、私の勤務先と現所居住している場所はどちらもカリフォルニア州なのですが
会社の本社のが東海岸であったため、
別居しているのではないかかという指摘でした。
別居している場合は、これらの住所について説明した宣誓供述書を提出してください。ということでした。

私の法律相談事務所の担当者曰く、厳しい人に当たってしまったようです💦
最初の書類申請で証拠書類も含めて準備したいたのですが、
受理されていないものもあったのが、なんとも悔しいです。

3、移民局から求められていた書類のリスト

移民局から提出を求められたのは、以下のような書類です。
RFEには具体的にこの資料を準備してくださいと明記されています。

  1. 婚姻中に生まれた子供の出生証明書
    Birth certificate(s) of child(ren) born to the marriage

  2. 養子にした子供の養子縁組証明書
    Adoption decrees of children adopted by you and/or your spouse,

  3. 養子に関する裁判所の後見人記録
    Court guardianship records of stepchildren

  4. 継親を連絡先または保護者として記載した学校記録
    School records listing the stepparent as a contact or guardian

  5. 継親を連絡先または後見人として記載した医療記録
    Medical records listing the stepparent as a contact or guardian

  6. 共同居住を示す両名義の賃貸契共同居住を示す両名義の賃貸契約
    Leases in both names showing joint occupancy

  7. 共同所有権を示す両名義の証書や抵当権
     Deeds and mortgages in both names showing joint ownership

  8. 婚姻期間中の入出金を示す2人の名前の銀行口座明細書
     Bank account statements in both your and the beneficiary's names showing deposits

  9. 婚姻期間中の入出金が記載された2人の両方の名前の銀行口座明細書
    withdrawals for the period of your marriage;

  10. もう一方の配偶者を受取人とする保険証書
     Insurance policies that show the other spouse as the beneficiary

  11. 連邦税および州税の共同申告書
     Joint federal and state tax returns;

  12. 共同公共料金請求書
     Joint utility bills

  13. その他のローンやクレジットカードの口座明細書
    Joint installment, other loans, or credit card account statements.

  14. 遺言書
    A will

  15. 信託
    A trust

  16. 健康管理、財産に関する耐久性のある委任状
    A durable power of attorney for health care, property

  17. あなたの結婚生活をよく知る第三者からの宣誓供述書
    Affidavits from third parties who are familiar with your marriage
    ※あなたのために宣誓供述書を提出する人は、フルネーム、住所、生年月日と場所を提供しなければならず、入国審査官の前で証言しなければならない場合もあります。

  18. その他の証拠書類
    Please submit any other evidence that will help USCIS determine whether you and the beneficiary have a bona fide marital relationship.

2、証拠資料の準備

上記の内容と法律相談事務所の指導を受けながら、3週間弱で15種類の書類を準備しました。
準備し提出した資料は以下のものです。

1、提出した書類

  1. 宣誓供述書を3通(義父と義母・私の友人・妹)
    affidavit

  2. 名刺
    busimess card
    ※勤務先がカリフォルニアであるための証拠として

  3. 運転免許証
    Drivers licence
    ※再送

  4. 勤務先からのレター
    Employment Verification Letter
    ※勤務先の住所を明記してもらいました

  5. 保険金受取人が記入された書類　2通
    Insurance Beneficiary Form

  6. 連邦税および州税の明細書
    Joint bank Accountant
    ※再送とさらに直近5か月分

  7. 税金申告
    tax return

  8. 給与明細
    Pay stub

  9. W-2源泉徴収票　3年分
    W-2

  10. リース契約なしの供述書
    No lease agreemnt
    ※共同公共料金請求書がないため

  11. 結婚式の写真 10枚ほど
    Wedding Photographs
    ※ワードにまとめました

  12. 結婚 お知らせカード

2、書類のテンプレート

XXXX announced their marriage in August 20xx and invited us on a holiday trip, which also included some of our close friends.
They exchanged rings, and they were really happy. The marriage took place in September 20xx, and we helped them with the arrangements. They also hinted at their desire to have children soon. I wish them all the luck in their life together.

3、ポイント

🌟前回提出した書類を受理されていない場合は、再提出。
前回提出した旨を伝える。

例
【Resubmission】
・The Petitioner's and the beneficiary's California State driver's licenses, both listing the current residential address.
・This document was previously submitted with the original petition package but was not listed on the RFE letter.

🌟強調したい箇所(住所や名前)を蛍光ペンで線を引く。
🌟余計なものは送らない。

4、送り方

  1. USCISアカウントにログイン

  2. I-130

  3. Your Case

  4. Documentsタブをクリック

  5. Upload Evidence

  6. ファイルを選択

  7. カテゴリーは「RFE Response」

  8. アップロード

🌟12MB以下にすること。
🌟一度に送れるファイルは5種類。複数回に分けて提出すること。
🌟原本を要求された場合は、その証拠を郵送で提出する。

RFEが届くと焦ると思います。
