【英日対訳】「児童ポルノ」に代わる用語としてインターポールが推奨する『適切な用語 』(Appropriate Terminology)｜ICPO国際刑事警察機構（2016年9月）

はじめに

2016年1月末、国際刑事警察機構ICPOを含む18の国際機関、政府機関、警察機構、非政府組織が参画したInteragency Working Group（IWG※1) が発表した『児童を性的虐待及び性的搾取から保護するための用語ガイドライン』 (通称: 『ルクセンブルグ・ガイドライン※2』 (TERMINOLOGY GUIDELINES FOR THE PROTECTION OF CHILDREN FROM SEXUAL EXPLOITATION AND SEXUAL ABUSE) ） は、日本で表現・人権・法曹に携わる者の重大な関心事である「児童ポルノ」の問題も取り扱うものだった。

かつて日本ではこの表現をめぐり、(A) 『児童ポルノ (child pornography) 』ではなく 、(B) 『児童性虐待記録物 (child sexual abuse material: CSAM) 』とすべきという署名運動が行われ、1万人余の署名を集めたことがあったが、ICPOが独自に（B）を採択した背景には2年間に及ぶ深い国際議論があった。

2016年6月、ICPOは改めて『ガイドライン』を推奨する表明を行った。肝心の『ガイドライン』の内容を把握したいま、改めて現在ICPOが推奨する用語がそれ以後どのように変化したのかを追う。

以下は、現在のICPOのサイトに展開される "Appropriate terminology (適正な用語)"に関する常設ページの和訳である。2011年当時に、NPO法人『うぐいすリボン』が和訳を公開したことがあったが、それから常設ページの掲載内容は変化した。いつ変更されたかは定かでないが、『うぐいすリボン』の和訳の差分として訳出してみることにした。

Appropriate terminology

インターポールでは、児童の性的虐待や性的搾取の問題の矮小化を避けるべく、適切な用語の使用を推奨しています。

At INTERPOL, we support the use of appropriate terminology to avoid trivializing the sexual abuse and exploitation of children.

定義や用語は、既存法が改正され被害者の権利保護状況が改善されていくにつれ、徐々に変化してゆきます。また、新たな形態の虐待や搾取が表面化しており、これらの動向に合わせて新しい、適切な用語が必要になってきています。

Definitions and terms are slowly changing as legislation is revised and the victims are given better protection and rights. Also, new forms of abuse are emerging and, with them, the need for new and accurate terminology.

深刻な犯罪には深刻な定義を

Serious crime, serious definition

性的に虐待され、これを撮影されたり、録画されたりした児童は保護され、配慮されるべき存在です。この虐待行為の重大性を『ポルノ』などという言葉で矮小化してはなりません。

Children who have been sexually abused and photographed or filmed deserve to be protected and respected, and not have the seriousness of their abuse reduced by the use of terms such as “porn”.

『ポルノ』という言葉は、一般人を対象に性的娯楽を目的で（ほぼ）合法的に流通する、成人同士が同意の下で性行為に従事する模様を収録した記録物を指します。児童虐待影像には、同意できるはずのない、また同意していない、犯罪の被害者である児童の存在があります。

Pornography is a term used for adults engaging in consensual sexual acts distributed (mostly) legally to the general public for their sexual pleasure.
Child abuse images involve children who cannot and would not consent and who are victims of a crime.

“Kiddy porn (こどもポルノ)“や"Child porn (幼児ポルノ)” といった言葉は犯罪者が使う言葉であり、法の執行機関や司法機関、また一般に公共やメディアの場で使用されるべき適切な言葉ではありません。

Terms such as “kiddy porn” and “child porn” are used by criminals and should not be legitimate language used by law enforcement, judiciary, the public or media.

一部の国の法制において、また場合によっては児童の性虐待扱う警察機構内の部署でも、"child pornography (児童ポルノ)“ の用語が使われることがあり、この用語の使用を避けるのは困難な状況があります。しかし、司法執行機関のコミュニティにおいては、このような犯罪を的確に表現するという業界文化の転換に貢献していただきたいと思います。

Legislation in some countries, or even the departments dealing with child sexual abuse within the police, may use terms like "child pornography”, making the term difficult to avoid. However, we encourage the law enforcement community to contribute to a cultural change by being precise in the way that such crimes are described.

推奨される用語

Recommended terminology

国際的なガイドラインより、これらの分野において的確な用語が提案されています。

A set of international guidelines makes precise recommendations on appropriate terminology in this area.

  • 「注意を要する、或いは全く使用すべきでない」用語として、'child pornography (児童ポルノ)’, ‘child sex tourism (児童売春ツアー)’ 及び ‘child prostitution (児童売春)’ 等

- Terms to be used with caution, or avoided completely, include 'child pornography’, 'child sex tourism’ and 'child prostitution’

  • 「より適切な」用語として、'child sexual abuse (児童性虐待)’, ‘sexual exploitation of children in the context of travel and tourism (旅行及び観光の文脈における児童の性搾取)’ 及び ‘exploitation of children in/for prostitution (買春行為における（による）児童の搾取)’等

- More appropriate terms are ‘child sexual abuse’, ‘sexual exploitation of children in the context of travel and tourism’ and ‘exploitation of children in/for prostitution’.

国際的に認知され調和された用語は必須であり、とくに被害者の特定の分野においてデータ収集及び関係諸機関、セクター、国々の連携を強めるためにも不可欠です。

The development of harmonized and internationally recognized terminology is essential, particularly in the context of victim identification, in order to strengthen data collection and cooperation across agencies, sectors and countries.

ICPOでは、これらの『ガイドライン』をベストプラクティスとして実務運用し、世界各国の法執行機関に対して推奨してゆきます。

INTERPOL will implement these guidelines as best practice and recommend their use to law enforcement across the globe.

用語解説

※1「IWG」

IWG: Interagency Working Group on Sexual Exploitation of Children (児童の性的搾取に関する国際関係機関ワーキンググループ)とは、「子どもへの暴力」に関する国連事務総長特別代表、国連人権高等弁務官事務所 (OHCHR)、「子どもの人身売買、児童売春、児童ポルノ」に関する国連特別報告者等の個人、及び児童の権利に関する国連委員会、国連児童基金 (UNICEF)、国際労働機関 (ILO)等の国連の諸機関や関連機関、欧州評議会、ユーロポール、インターポール等の政府間機関、 米州子ども研究所 (IIN) 、 国際行方不明・被搾取児童センター (ICMEC) 等の研究機関、及びセーブ・ザ・チルドレン、PLANインターナショナル等の非政府機関 (NGO) 等18の団体と個人が参加する、関係諸機関の国際ワーキンググループ。タイに本部を置く非政府組織EPCATインターナショナルが主導して2014年9月に設立された。

※2「ルクセンブルク・ガイドライン」

 『ルクセンブルク・ガイドライン』（The Luxembourg Guideline）とは、 IWGが2016年1月に発表した "Terminology Guidelines for the Protection of Children from Sexual Exploitation and Sexual Abuse (児童を性的搾取及び性的虐待から保護するための用語ガイドライン)。114ページに及ぶ包括的なガイドラインで、児童に関わる性的搾取行為や性的虐待行為に関して国際機関、政府機関や警察機関が使用するあらゆる表現・用語を網羅し、これらに対する「適切な用語」を提案する。日本でムーブメントとなった、法定用語としての「児童ポルノ」にかわる用語としての”child abuse material (児童虐待表現物 “ という言葉は、この議論から生まれた結果の一部だった。全体のどういったコンテクストでこの用語に落ち着いたのかについては、『ガイドライン』本編 （PDF) を参照（p.38～40）。
