【ウクライナとは?】
東欧にある国で、北はベラルーシ、東はロシア、西はポーランド、スロバキア、ハンガリー、南はルーマニア、モルドバと国境を接し、アゾフ海、黒海に沿った海岸線を有する。面積は603,628平方キロメートル(日本の約1.6倍)、人口は4130万人(欧州で8番目に多い)、首都はキエフである。聞いたことがあるとすれば1986年4月26日に旧ソ連邦ウクライナ共和国で起きたチェルノブイリ原子力発電所事故だろうか。
政治に関して言えば、1991年に独立して以降、大統領選挙では親露派と親欧米派が対立してきており、両派閥の大統領が入れ替わり立ち替わりで政権運営してきた歴史がある(第2代大統領は中道、第3代は欧米派、第4代は親露派、第5、6代は欧米派)。
【ウクライナの歴史概要】
中世以前からウクライナ地域は他国からの支配と独立を繰り返しており、近代以降もロシア帝国とオーストリア帝国による抑圧政策、特にロシア帝国はウクライナに対するロシア化政策を実施していた。第一次世界大戦が勃発するとウクライナを巻き込んだ東部戦線が形成された。1917年にロシア帝政が崩壊してからはウクライナ・ソビエト戦争が勃発。1918年1月9日にウクライナ人民共和国の独立を宣言するも、内部で枢軸国派と連合国派による対立でクーデター等が起こり政権が倒される事態が起こる。ドイツが降伏した際は連合国派が政権を握るも、ドイツ軍が撤退すると。ウクライナ・ソビエト戦争が再開する。1919年1月6日にソビエトの傀儡政権としてウクライナ・ソビエト社会主義共和国を樹立し、1920年冬には戦争がソビエト赤軍の勝利で終結、ウクライナ・ソビエト社会主義共和国がウクライナ地域の殆ど(西ウクライナを除く)を確保。その一方で1918年10月19日に独立した西ウクライナ人民共和国はポーランドが侵入し、ウクライナ・ポーランド戦争が勃発してしまう。国際的に孤立していた西ウクライナはウクライナ人民共和国に援助を求めるも、当時はソビエト赤軍と戦争していたため援軍派遣ができなかった。ポーランド1919年7月18日に西ウクライナ全地域を占領したため、西ウクライナ人民共和国は滅亡する。その後、1920年4月に西ウクライナをめぐりポーランド・ソビエト戦争が勃発。1921年3月18日のリガ条約によって西ウクライナのポーランド支配が確定した。1922年12月30日にウクライナ社会主義共和国は、ロシア、ベラルーシ、ザカフカースとともに同盟条約によってソビエト連邦を結成した。そして1991年の独立まで約70年間の間、ソ連圏の構成国として支配下に置かれることになる。
【ウクライナの弱体化】
1991年にソ連から独立した際、ウクライナは兵士780万人、戦車6500輌、戦闘車両7000輌、大砲7200門、軍艦500隻、軍用機1100機、1240発の核弾頭(当時世界第三位の規模の核兵器)、176発の大陸間弾道ミサイルを偶然ソ連から受け継いだ。これらはソ連の軍事戦略上、欧州方面に位置するウクライナに大規模な軍隊を駐屯・展開させておく必要があったためである。だが、独立してからは大規模な軍縮が行われた。当然核兵器についても米露から放棄するよう脅迫に近い圧力(経済・軍事的制裁や国際社会からの孤立)がかけられていた。当時ウクライナは経済危機やハイパーインフレに苦しんでおり、圧力へ抵抗する力はなく、ウクライナの指導者達は外国の要求をすべて呑み、無条件に3年間で全核兵器を放棄する決断を下した。その見返りとして米英露はウクライナの領土的統一と国境の不可侵を保証する内容の覚書を発表した。ここが肝であるが「覚書」は国際条約と異なり法的拘束力がない。もし仮にウクライナが条件を突っぱねて核兵器や軍事力を保持していれば現在とは異なった世界情勢になっていたかもしれない。
さて、ここでニュースに出てくる二つのキーワードを説明しよう。どちらもウクライナの現状を理解する上で重要なことであることは間違いない。
【1. ミンスク合意】
2014年4月にドネツク人民共和国(自称国家)、ルガンスク人民共和国(自称国家)はロシアへの編入を求めて親ロシア派武装勢力が武装蜂起して実効支配し一方的に独立宣言した自称国家である。これに対応するために2014年9月5日にウクライナ、ロシア、ドネツク人民共和国(自称国家)、ルガンスク人民共和国(自称国家)が調印し、ドンバス地域における戦闘停止について合意した文書をミンスク議定書と呼んでいる。これは欧州安全保障協力機構(OSCE)の援助の下でベラルーシのミンスクで調印されたが、2022年2月22日にロシアのウラジーミル・プーチン大統領がドネツク・ルガンスク両州の独立を認める大統領令に署名したことにより、ミンスク議定書の効力は事実上破綻してしまった。尚、議定書の項目は以下の12個である。

本覚書は、ウクライナ、ベラルーシ、カザフスタンの領土保全と政治的独立に対する脅威又は軍事行使に対する安全保障に関する取り決めである。 その結果、1994年から1996年の間にこの3カ国は核兵器を放棄(厳密にはロシアへ移転させた)した。内容は「米英露は、ウクライナ、ベラルーシ、カザフスタンが核不拡散条約の加盟国になったことを認め、核兵器をロシアに引き渡すことで、次の事項を取り決める」とした。
尚、覚書に法的義務が生じるかどうかに関わらず、ウクライナについては2014年から遭遇している難儀は、不拡散の誓約と引き換えに提供されているはずの安全保障の信頼性に疑問が生じていると言えなくもない。
【NATOの東方拡大の歴史】
北大西洋条約機構(NATO:North Atlantic Treaty Organization)とは、ベルギー・ブリュッセルに最高司令部を置く欧州及び北米の30ヶ国による軍事同盟であり、1949年4月4日に調印された北大西洋条約の執行機関である。結成当初は、ソ連を中心とする共産圏(東側諸国)に対抗するための西側陣営の多国間軍事同盟であり「アメリカを引き込み、ロシアを締め出し、ドイツを抑え込む」としていた。冷戦後は新たな存在意義を模索する必要性に迫られたため、自らの存立意義を「軍事同盟の枠組み」から「国際同盟の ための政治枠組み」へと変更した上で、新戦略概念を策定し、「集団防衛」、「危機管理」及び「協調的安全保障」の三つを中核的任務と加盟国の領土及び国民を防衛することが最大の責務とした。尚、1997年7月のNATO首脳会議以降、門戸開放政策(オープン・ドア・ポリシー:申請を行い、 条件を満たした国から順に加盟を承認する方針)を掲げてきたており、加盟国が増え続けている。

大国復活の野望を抱くプーチン大統領は繰り返し、NATOの東方拡大を止めるように求めてきたことはニュースでも聞いたかもしれない。上記の加盟している国々を見ればわかる通り、徐々にロシアと接するように拡大してきているのがわかる。また、今回問題になっているウクライナは自らの勢力圏に留めておくことは絶対条件であり、NATOへの加盟がないよう確約をNATOに求めているのには理由がある。それは旧ソ連圏の同胞であり、同じ民族であるために結束を夢見ていることは勿論のこと、やはりウクライナやベラルーシ(ここは親露なのでNATOには加盟しないだろう)が欧州とロシアの緩衝地帯であり、ここを奪われるのは阻止したいと思うのは道理が通っている。
【NATO対ロシアの戦争は起きるのだろうか?】
ここからは私の考察になるが、第二次世界大戦以降、核保有国が直接的に互いに武力行使をしたことはない。冷戦あるいはそれ以降の中東での武力衝突は多国籍軍が非核保有国へ武力行使をしていたケースや大国が非核保有国や武闘派組織に対して後方支援していた所謂「代理戦争」は各地で繰り広げられていたので、今回もウクライナを戦場として代理戦争が行われる可能性は十分に考えられる。
次にロシアがクリミア半島やドネツク州及びルガンスク州への侵攻を国際法的観点から考察してみよう。まず、何故ロシアは「国家承認」をしたのか?それは国家と認識せずに他国へ侵攻した場合、国際刑事裁判所規程に定める「平和に対する罪(Crime against Peace)」に該当する可能性があるためだ。「平和に対する罪」とは「侵略戦争または国際条約・協定・保障に違反する戦争の計画・準備・開始および遂行、もしくはこれらの行為を達成するための共同の計画や謀議に参画した行為」と定めており、立派な戦争犯罪なのである。だが、逆に国家承認するとどうなるのだろうか?樹立した新国家がウクライナから攻撃を受けている(前提としてウクライナ軍は自国民の反政府組織と戦闘していた訳だが...これが外国人になってしまう)と主張することができ、国連憲章第51条に基づき、ロシアは集団的自衛権を合法的に行使できる可能性がある。
逆に欧米諸国側の現時点で取れる措置を考察してみる。まず、彼らは一斉に経済制裁を講じているが、これは国連憲章になぞったように対応しているためであると考えることができる。実際問題として、国連安全保障理事会(国連安保理)の常任理事席にロシアがいる以上(国連安保理は常任理事国の全会一致でなければ決議されない)、国連が行動することは現実的ではないので、疑似的に非軍事的措置として経済制裁を実施したと言える。だが、経済制裁を持ってしてもロシアを止めることが出来ない場合は軍事的措置を検討しなければならない。ウクライナはNATO加盟国では無いため同盟国を守るという大義名分(集団的自衛権を行使する名目)が現時点ではなく、国連憲章第51条を発動する正当性を示すことは難しい。これ以外の選択肢としては国連憲章第42条に定める方法で国連軍(多国籍軍)を派遣することだろうが、これは国連安保理の決定がなければならず、前述の通り、ロシアがこれを認めることはまずない。支援物資を送ることは勿論できるが、これには限界があるだろう。
【平和のための結集の決議】
ここまで、国連内での合法的選択肢を考察してきたが、「結局どうすることもできないってこと?」と思われたことだろう。だが、実は過去に何回か国連安保理を迂回して国連を動かした事例が存在する。それが、「国際連合総会決議377 A(V)(通称:平和のための結集の決議, Uniting for Peace Resolution)」である。これは国際的な平和・安全を維持するために国際連合が行動する必要があるにも関わらず、常任理事国の全会一致の合意が得られないために国連安保理が必要な行動をとることができない場合、又は常任理事国が拒否権を行使して安保理が国連憲章で定められた機能を遂行するのを妨害している場合に、国際連合総会が国連安保理に代わって行動することができるという決議である。国連総会は、国際的な平和・安全を維持・回復するために、必要に応じて武力の行使を含む集団的措置について国連加盟国に適切な勧告を行うことができるとしている。尚、国連安保理が膠着状態に陥った場合は国連総会が迅速に行動を起こすことができるように、決議では「緊急特別総会」という仕組みを設けており、緊急特別総会はこれまでに10回招集された(最後の招集は1997年だが、第10回緊急特別総会は2022年現在でも閉会されていないことになっている)。
本決議は元々、1950年にアメリカ合衆国が主導し、7か国共同(米・英・仏・加、トルコ、フィリピン、ウルグアイ)で提出されたものであり、当時は朝鮮戦争中(1950年6月25日 - 1953年7月27日)に、ソ連が拒否権を行使するのを回避するための手段であった。この決議案は、14日間に及ぶ総会での討議の結果、同年11月3日に賛成52-反対5-棄権2で採択された。反対票は「チェコスロバキア、ポーランド人民共和国、ソビエト連邦、ウクライナ・ソビエト社会主義共和国、白ロシア・ソビエト社会主義共和国」と共産陣営の国々であり、棄権したのは「インド、アルゼンチン」である。
尚、「平和のための結集」決議は、1951年から1997年の間に12回発動されているが、その内、国連安保理が7回、国連総会が5回発動している。また、そのうち10回は緊急特別総会が招集されている。
国連総会で平和のための結集決議が採択され、その結果として慣習国際法となった総会の権限の解釈を考えれば、安保理の拒否権の問題は乗り越えられると主張されてきた。この決議は、国連憲章に基づき、国連安保理が平和維持の「主たる責任」を果たせなかった場合、国連総会が国際的な平和と安全を回復するために必要なあらゆる行動をとることを、常任理事国は妨げることはできないし、妨げるべきではないという宣言でもある。つまり、国連総会は国際的な平和と安全に関する問題についての「最終的責任」を与えられており、国連安保理の拒否権を無効にする仕組みを総会に提供するものであると明確に言及しているのである。
この仕組みを用いれば、常任理事であるロシアの拒否権を恐れることなく、国連は適切な措置を検討し、対処する道が開けることになる。
【まとめ】
ここまで長くなったが、広げた風呂敷を少しずつまとめていこうと思う。現在のウクライナへの侵攻はロシアにより巧妙に組まれた計画であることは明確である。上記でウクライナの歴史と弱体化の理由、ロシア圏の拡大とNATO東方進出阻止の思惑、ロシアの合法的な侵攻作戦、欧米諸国が取れる選択肢を考察してきた。ではこの先、どうなりうるのか?
①欧米諸国とロシアが外交的妥協点を見出し、侵攻前の状況に戻る(外交政策)。
②ウクライナの領土は縮小するが大規模な戦闘を回避することを欧米諸国が良し、ロシアの編入を黙認する(宥和政策)。
③小競り合いするウクライナとロシアを見届けつつ、ロシア経済を崩壊させることに力を入れる(非軍事的措置)。
④欧米諸国とロシアの間で新たな冷戦が勃発し、どちらかが折れるまで長期的に局地的な戦闘が発生する(代理戦争)。
⑤国連軍(欧米諸国の多国籍軍)とロシアの間で非核戦争が勃発(軍事的措置)。
いずれの選択肢も国際法の観点からみれば、可能なのだろう。だが、将来的な平和と安定性を考えるのであれば、ロシアには自国の領土に軍を戻し、停戦することが望ましい。プーチン大統領が支持率と自らの任期を気にして、支持率向上のために武力行使に踏み切ったというニュースも見るが、政治的野心のために国民を犠牲にし、権力を手にするのは一番愚行である。選挙もロシア拡張の夢も諦め、欧米諸国に寄り添い経済的発展を目指すことは不可能なのだろうか?勝者のいない戦争に意味はない。直ぐにウクライナ情勢を安定化させる道を願いつつ、ここで終えたいと思う。

Ukraine seeks to join North Atlantic Treaty Organization (NATO), which continue to expand Eastward even after the end of the Cold War, which conflicts with Russia wanting to absorb the former Union of Soviet Socialist Republics (USSR) territories as its own sphere of influence as a foothold for the revival of the “Empire”. Therefore, collisions are inevitable with national interests getting in the way of peaceful resolution.
【Where is Ukraine?】
It is a country in Eastern Europe, bordering Belarus in the North, Russia in the East, Poland, Slovakia, Hungary in the West, Romania in the South, and Moldova in the South, and has a coastline along the Azov Sea and the Black Sea. The size is about 1.6 times that of Japan with a population of 41.3 million (8th largest in Europe). Capital is Kiev and you might recognize the name of the county from the “Chernobyl nuclear power plant incident” that occurred in the former Soviet Union Ukraine on April 26, 1986.
In terms of politics, since independence in 1991, pro-Russian parties and pro-Western parties have been in conflict getting the presidential power. The presidents of both factions have a history of taking turns running the government (2nd=neutral, 3rd=pro-Western, 4th=pro-Russian, 5th&6th=pro-Western).
【Ukraine Weakening】
Upon independence from the USSR in 1991, Ukraine had 7.8 million soldiers, 6500 tanks, 7000 combat vehicles, 7200 cannons, 500 warships, 1100 military aircraft, and 1240 nuclear warheads (the third largest in the world at the time), 176 intercontinental ballistic missiles. These weapons were “accidentally” inherited from the USSR because the USSR's military strategy required that large-scale military to be stationed and deployed in Ukraine, which was nearest location to Western Europe.

After the Cold War, NATO were forced to reshape it's form and created a new strategic concept from the "Framework for a military alliance" to the "Political framework for an international alliance". And "collective defense", "crisis management" because the core mission. NATO leadership in July 1997 decided to take "Open door policy", which states "We expect and would welcome NATO expansion that would reach to democratic states to our East".
NATO has added new members eight times since its foundation in 1949 with a current total of 30 members. Twelve countries took part in the founding of NATO: Belgium, Canada, Denmark, France, Iceland, Italy, Luxembourg, the Netherlands, Norway, Portugal, the United Kingdom, and the United States. In 1952, Greece and Turkey became members of the Alliance, joined later by West Germany (in 1955) and Spain (in 1982). After this fourth enlargement in 1999, the Vilnius group of the Baltics and seven East European countries formed in May 2000 to cooperate and lobby for further NATO membership. Seven of these countries joined in the fifth enlargement in 2004. The Adriatic States Albania and Croatia joined in the sixth enlargement in 2009, Montenegro in 2017 and North Macedonia in 2020.
You may have heard in the news that President Putin, who has the ambition to revive the great power, has repeatedly called for NATO to stop expanding Eastward. As you can see from the names of NATO alliances above, NATO is gradually getting closer to reaching Russian boarder. Excluding the side that Russia wants Ukraine, which is in question this time, to become part of its sphere of influence, but there are other reason for asking NATO to make a commitment not to join NATO. Ukraine was politically, culturally and ethnically compatriot of the former USSR, but Ukraine and Belarus (which will not join NATO because it is a pro-Russia) is acting as buffer zone between Europe and Russia. Considering Russia's capital from being very close to European side, it makes sense for Russian to wanting to prevent Ukraine from be-siding with "Long-time Hypothetical Enemy".
【Will there be a war between NATO and Russia? ]
From here on, my consideration is that since World War II, none of Nuclear Powers have directly used force against each other. There were cases during the Cold War or conflicts in the Middle East were multinational forces used force against non-Nuclear Powers or Superpowers providing logistical support to non-Nuclear Powers and militant groups to fight on behalf of their national interests (so-called "proxy wars"). 【Uniting for Peace Resolution】
So far, I've considered legal options within the UN, but many of you might have probably wondered, "What can we do after all?". In my years of studies I have come across an interesting case in the UN history. There have been cases in the past where the UN was moved by bypassing the UNSC several times. This is known as "United Nations General Assembly Resolution 377 A (V)".
The "Uniting for Peace" resolution, states that in any cases where the UNSC, because of a lack of unanimity among its five permanent members, fails to act as required to maintain international peace and security, the UNGA shall consider the matter immediately and may issue appropriate recommendations to UN members for collective measures, including the use of armed force when necessary, in order to maintain or restore international peace and security.
It was adopted on 3 November 1950 by the UN General Assembly (UNGA), after fourteen days of discussions, by a vote of 52 to 5, with 2 abstentions. This was a response to the strategy of the USSR to block any determination by the UNSC on measures to be taken in order to protect the Republic of Korea against the aggression launched against it by military forces from North Korea. At the initial stage of this armed conflict, in June 1950, the UNSC had been able to recommend to the Members of the UN to “furnish such assistance to the Republic of Korea as may be necessary to repel the armed attack and to restore international peace and security in the area”. The resolution was able to pass because the USSR, boycotted the meetings of the UNSC with the aim of obtaining the allocation of the permanent Chinese seat to the communist Government in Beijing. It assumed that in its absence the UNSC would not be able to discharge its functions since Article 27, paragraph 3, of the Charter provides that substantive resolutions of the UNSC require an affirmative vote of nine members “including the concurring votes of the permanent members”. The majority of the members of the UNSC, however, were of the view that absence from the meeting room could not prevent the key organ of the UN from acting validly, a view that was later endorsed by the International Court of Justice. The USSR sent a delegation from 1950 to the meetings of the UNSC which cast a negative vote on the US draft resolution condemning the continued defiance of the UN by the North Korean authorities. In order to overcome this impasse, the US succeeded in persuading the UNGA that it should claim for itself a subsidiary responsibility with regard to international peace and security, as enunciated by Article 14 of the Charter.
To facilitate prompt action by the UNG in the case of a deadlocked the UNSC , the resolution created the mechanism of the "emergency special session (ESS)". ESS have been convened under this procedure on ten occasions, with the most recent convened in 1997, to address the Israeli–Palestinian conflict. However, unlike the preceding ESSs, the tenth ESS has been "adjourned" and "resumed" on numerous occasions over the past several years, and remains adjourned. Indeed, more than ten separate meetings have been held by the Assembly, whilst sitting in the tenth ESS, since 2000.
It has been argued that the UNSC's veto issue can be overcome given the interpretation of the power of the UNGA as customary international law. Under the UN Charter, this resolution states that if the UNSC fails to fulfill its "main responsibility" for peacekeeping, the UNGA will take all necessary actions to restore international peace and security. This is also a declaration from UNGA to UNSC permanent member countries that they cannot and should not be disrupting peace through veto privilege. In short, the UNGA has been given "final responsibility" for international peace and security issues and clearly states that it provides the UNGA with a mechanism to revoke the UN Security Council's veto power. With this mechanism, the UN will be able to consider options and deal with appropriate measures without fear of Russia's veto power.
【Conclusion】
It is clear that the current invasion of Ukraine is a well planned by Russia. In the above, we have considered the history of Ukraine and the reasons for its weakening, the speculation of the expansion of the Russian "empire" and the prevention of NATO's advancement into the East, the possible legality of Russia's action, and the options for Western countries to act on. So to conclude what sort of scenarios can happen in the future?
(1) Western countries and Russia find a diplomatic compromise and return to the situation before the invasion (Foreign Policy).
(2) Although Ukraine's territory will shrink, Western countries aim to avoid large-scale battles by acknowledging Russia's annexation (Appeasement Policy).
(3) While watching over Ukraine and Russia in skirmishes, Western countries will focus on disrupting the Russian economy (Non-military Measures).
(4) A new Cold War broke out between Western countries and Russia, and a long-term regional battles will occurred until one of side breaks (Proxy War).
⑤ A non-nuclear war breaks out between the UN forces (multinational forces of Western countries) and Russia (Military Measures).
Any of the options above may be possible from the perspective of international law. However, considering future peace and stability of the region, it is desirable for Russia to ceasefire and return its troops to its own territory. There're news that President Putin has decided to use armed forces to increase his approval rating because (His term ends in 2024 and aims for reelection), but to sacrifice the people for political ambition and and strengthening own power is beyond foolish act. Is there a path where the president can let go the ambition for the election and the expansion of Russia, and divert all the power and resources to economic development and be side-by-side with Western countries? There is no winner in war, only sorrow and destruction. I will end here, hoping to stabilize the situation in Ukraine soon.
